The Vietnamese-American story is one of the largest migration stories in the US. Remittances to Vietnam reached about $16 billion in 2024, with Ho Chi Minh City alone expecting around $10.5 billion in 2025.
And the traffic is no longer just family money moving west to east. A generation of sellers in Ho Chi Minh City, Hanoi, and Da Nang now earns dollars directly from American customers, through Amazon storefronts, print-on-demand shops, and US LLCs registered from a laptop. That is the community this guide is really for, along with the Vietnamese spouses of US citizens who need an ITIN for a very different reason. Both groups run into the same three walls: a treaty that exists on paper but not in law, a local tax number the IRS has never heard of, and a country with no one authorized to certify a passport copy for the IRS. Here is how to get through all three.
Vietnam's US Tax Treaty Was Signed in 2015. It Still Isn't in Force.#
This is the fact that reshapes every Vietnamese ITIN application, and almost nobody explains it straight. On July 7, 2015, the United States and Vietnam signed their first-ever income tax treaty. Vietnam's National Assembly ratified it in early 2017. The US Senate never did. Then the 2017 US tax reform rewrote the very corporate rules the treaty text relied on, leaving the signed document out of step with US law and stuck in renegotiation ever since.
The file is not dead. In May 2025, tax officials from both governments held technical talks on the double taxation agreement on the sidelines of the SelectUSA Summit, co-chaired by Vietnam's General Department of Taxation and the US Treasury. But talks are not law. As of 2026, Vietnam does not appear on the IRS list of countries with income tax treaties in force. Look under "V" and you find Venezuela, not Vietnam. Meanwhile Vietnam holds double tax agreements with around 80 other countries. The United States, its largest export market, is the one major trading partner missing from that list.
What does that cost you in practice? When a US payer sends dividends, interest, or royalties to a nonresident, the default withholding is a flat 30%, unless a treaty says otherwise. The form for claiming a lower rate is the W-8BEN, and it asks you to name the treaty article you rely on. A Vietnamese resident has no article to cite. Why Vietnamese Sellers and Founders Need an ITIN#
Vietnam's cross-border e-commerce numbers are startling. The US LLC, the EIN, and Form 5472#
Here is the chain almost every serious Vietnamese seller eventually walks. Stripe does not support Vietnam, and PayPal's Vietnamese service is limited. The LLC solves the payment problem and creates a compliance one. A foreign-owned single-member LLC must file a pro forma Form 1120 with Form 5472 attached every year, on the company's EIN. The personal ITIN enters the picture the moment a personal filing does: a Form 1040-NR reporting US-connected income, a refund claim, or a platform or bank that insists on a personal US tax number behind the company. The June 2026 rule for multi-member LLCs#
One recent change matters specifically to Vietnamese founders who set up multi-member LLCs with partners or family. Effective June 1, 2026, an applicant claiming Exception 1(a) as a partner must include an excerpt of the partnership or LLC agreement showing the entity's name and EIN, backed by the CP 575 or 147C letter, when a CAA files the W-7 (IRS Acceptance Agent Program changes). Reclaiming over-withheld tax with Form 1040-NR#
Without a treaty, correctly withheld 30% on dividends is final, and no filing brings it back. But plenty of withholding is not correct. Platforms over-withhold on income that is effectively connected to a US business, gross proceeds get taxed as if they were pure profit, and backup withholding hits accounts with incomplete paperwork. The money comes back through a filed Form 1040-NR, and that return needs a US taxpayer number. For a Vietnamese founder without an SSN, that number is the ITIN.
Banking and the practical doors#
An ITIN also does quieter work. Many US banks and fintechs accept it in place of an SSN when you open a US bank account as a non-resident, and it is the number that can start a US credit file. For a seller running real dollar volume through a US LLC, a proper US account under your own tax number beats routing everything through intermediary wallets.
Your Mã Số Thuế Is Not an ITIN#
Search for "mã số thuế" and "ITIN" together and you will find forums confidently equating the two. They have nothing to do with each other. The mã số thuế (MST) is Vietnam's domestic tax code, issued under the Ministry of Finance for Vietnamese tax obligations. The ITIN is a US federal number issued by the IRS for US tax filings. Neither system reads the other's numbers.
And the MST just changed shape, which will make the confusion worse before it gets better. From July 1, 2025, under Circular 86/2024/TT-BTC, Vietnam replaced individual tax codes with the 12-digit personal identification number from the CCCD card. Your CCCD number now is your Vietnamese tax code (KPMG Vietnam). That is a genuine simplification inside Vietnam. It changes nothing in the US. You cannot put an MST or a CCCD number on a W-8BEN, a 1040-NR, or a joint return. Getting an ITIN for a Vietnamese Spouse of a US Citizen#
The seller story dominates the headlines, but the family story quietly drives some of the largest refunds. In fiscal year 2022, 87% of Vietnamese green cards were issued through family reunification, one of the highest family shares of any origin country. Behind that statistic are thousands of couples where one spouse is a US citizen and the other is a Vietnamese citizen with no SSN, often still living in Vietnam while the immigration paperwork grinds along. Those couples can usually file a joint US return years before the visa arrives, and the ITIN is what makes it possible.
The switch is Internal Revenue Code section 6013(g). A US citizen or resident married to a nonresident alien can elect to treat that spouse as a US resident for tax purposes, and the couple then files married filing jointly like any American couple. For tax year 2025, filed in 2026, the joint standard deduction is $31,500 against $15,750 filing separately, rising to $32,200 versus $16,100 for tax year 2026. That is roughly $15,750 of extra income shielded from US tax every year, plus wider joint brackets.
Then there is the Child Tax Credit rule that families get wrong constantly. Under the 2025 tax law, the credit is worth $2,200 per qualifying child, up to $1,700 of it refundable, and the child must have an SSN. The claiming taxpayer must also have a work-valid SSN, but on a joint return only one spouse needs one. A US-citizen parent with an SSN, a Vietnamese spouse with an ITIN, and US-born kids with SSNs still claim the full credit for every child. The one honest trade-off: once the election is in place, the couple reports worldwide income, including the Vietnamese spouse's earnings, rental income in Ho Chi Minh City, or business income at home. Foreign tax credits usually soften that, but run the numbers before electing, not after.
Documents Needed for Your ITIN Application#
Three things make a complete package, and the order of importance surprises people. The passport matters most, the W-7 is just the form, and the attached tax reason is what makes the application valid. Miss any one and the whole package bounces.

- A certified copy of your Vietnamese passport, or the original. The current P-series passport, the dark blue-violet booklet issued since July 2022 with an embedded chip since March 2023, has a bilingual Vietnamese and English data page, so no translation issue arises. It proves both identity and foreign status on its own. A plain photocopy is rejected. So is a copy from a phòng công chứng, which we cover next.
- Form W-7, the ITIN application itself, current revision, signed and dated with the correct reason box checked. For a spouse case, that is the spouse box with the US citizen's name and SSN entered. For an Exception 1(a) partner case, the exception details go on the form.
- A reason the IRS recognizes. For most applicants this is a US federal tax return attached to the W-7: the couple's joint return with the 6013(g) statement, or a founder's 1040-NR. Exception filers attach their exception proof instead, such as the LLC agreement excerpt required from June 2026. A flawless passport copy with no valid reason still earns a rejection letter.
Two passport-specific notes. Vietnamese adult passports run a full 10 years, so expiry is less of a trap than in five-year-passport countries, but check the date anyway; the IRS rejects expired documents. And if your P-series passport was issued between July and September 2022, check the annotations page. The first blue passports omitted place of birth, several countries rejected them, and Vietnam fixed it with birthplace endorsement stamps from September 15, 2022 before restoring birthplace to the data page. An early-2022 booklet without the annotation is asking for document trouble, with the IRS and everyone else. Get it endorsed or renewed first.
The Passport Problem: How to Certify It from Vietnam#
This is where most Vietnamese applications stall. The IRS accepts a certified passport copy from exactly three sources, and a Vietnamese notary office is not one of them. A notarized copy from a phòng công chứng in District 1 or Hoàn Kiếm will be rejected no matter how many red stamps it carries. Here are the three routes that work.
Option A: The Immigration Department, the passport-issuing authority. The IRS accepts a certified copy from the agency that issued the document. This route is legitimate but slow in practice: certified true copies for foreign tax agencies are not the office's daily work, so expect an in-person visit, patience, and follow-ups.
Option B: The US Embassy in Hanoi or the US Consulate General in Ho Chi Minh City. Both posts offer notarial services to all nationalities, by appointment only, at $50 per consular seal. One caveat worth stating plainly: the notarial page does not itemize a certified true copy of a passport for ITIN purposes as a listed service, so email the consular section and confirm they will certify a passport copy for the IRS before you book and pay. Option C: An IRS Certifying Acceptance Agent. A CAA is authorized by the IRS to verify your identity and passport directly, then submit the W-7 with a Certificate of Accuracy. With an online CAA, the verification happens over a video call, so the passport never leaves Vietnam and nothing gets mailed to Texas except paper the IRS actually needs. A word on the mail-in alternative. Skip certification entirely and you must send your original passport to the IRS in Austin. From Vietnam, that means weeks of one-way transit, up to 60 days before originals come back by the IRS's own timeline, and a real risk of loss. People do lose passports this way. The risk is avoidable, so avoid it.
How to Apply for an ITIN from Vietnam, Step by Step#
The process is identical whether you are in Hanoi, Ho Chi Minh City, or Little Saigon. What changes is the certification route you choose in step three. Here is the full sequence.
- Confirm the tax reason and gather documents. Identify the trigger: a joint return with a US-citizen spouse, a 1040-NR for your LLC's US income, a refund claim, or an exception. Founders with multi-member LLCs should pull the LLC agreement and EIN letter now.

Read the fine print, because it matters more than the listing. On IRS country pages, an asterisk next to a name means the firm is a plain Acceptance Agent, not a Certifying Acceptance Agent, and this entry carries the asterisk. A plain AA can help you fill out the W-7 and review your documents, but it cannot certify your passport. You would still have to send the original passport to Austin or obtain a certified copy elsewhere. So the honest summary for a country of 100 million people with a booming cross-border seller economy is: one acceptance agent, zero certifying acceptance agents.

Common Mistakes Vietnamese Applicants Make#
- Sending a phòng công chứng copy. A Vietnamese notary office cannot certify your passport for the IRS, however official the seals. Only the Immigration Department as the issuing agency, the US Embassy or Consulate General, or an IRS CAA can. Do not pay for a notarized copy expecting it to work.

FAQ: ITIN From Vietnam#
Is there an IRS Acceptance Agent in Hanoi or Ho Chi Minh City?#
There is one plain Acceptance Agent, New Generation Consultancy in Ho Chi Minh City, on the IRS Vietnam list, and none in Hanoi. Vietnam has zero Certifying Acceptance Agents, so no one in the country can certify your passport for the IRS. Applicants use the Immigration Department, the embassy or consulate, or an online CAA.
Can a Vietnamese notary certify my passport for the IRS?#
No. The IRS does not accept notarized passport copies from a phòng công chứng or any Vietnamese lawyer.
